CPS has more authority that our police department. I was told by my county police department I have to right to disciple my children, but in return CPS has the right to call it abuse and remove them!! WHAT!! So what they are really saying is.. dont disciple your children and when they become of age and get into trouble with the police because they have no respect for authority, they can just go to jail!! Most of the CPS workers I have come in contact with are not married and dont have children. WOW!! So anyone can call them and tell them whatever they want and CPS will just come "kiddnap" your kids. Then make the parents jump through hoops to get the kids back. My kids want to come home!! They are depressed and unhappy. Not to mention are still grieveing over the suicide of their father 2 years ago the 29th of Nov 2011. My family has been riped apart by these 9 to 5 paychecks. I promise they dont care about my kids after 5 pm or on the weekends or holidays...while my kids and I cry 24/7. This will be the very first Thanksgiving and Christmas my kids not only get to miss their deceased father, but me also. In my opinion this is not protecting the kids..its torturing them and is abuse and neglect by CPS.

Rockwall County is just as corrupt, CPS specializes in tearing families apart. They send the parents jumping through hoops with psych evals, counseling, treatment for this and that; and for what? They go for termination from the beginning with no intention of returning the child. The more you "comply and complete" the service plan, the more they add to it. When you see a counselor or therapist that favors you getting your child back, then they make you find another one!! My advise for anyone that comes into contact with CPS; they will lie, cheat, conspire against you; get an ATTORNEY!!! No matter what it cost, because w/o one they will rake you over the coals and you will never be able to provide that "safe & stable environment" they refer to. And Chris Gilmer (CASA) a total joke!!! She has no business having the responsibility of a child in her grasp. A five year old will tell the truth on the stand before she will. She will ramble on and on with her untrue allegations based on heresay of who she decides to play favorite to and does not take the time to investigate for the truth. Do whatever it takes to prevent her from touching your case, she will destroy the life of your child before she will help them. The whole situation is screwed up and always will be. It's all about the money. No one is ever going to take the victims of CPS seriously, because we are just mad because we messed up and lost our children and only retaliating in anger. Wake up people, for years I have searched the internet for a way to right a wrong with them and i have NEVER found one positive reference to them; that should say something.

Wow. That's quite a litany of real horrors, fracturing lives by abusers and by those supposed to protect victims. How many of the CPS cases end in human disasters? One over-reaching incompetent CPS zealot has the chance to fragment many lives in every case. Why can't CPS identify such cases; they sometimes seem to be playing the part of the dis-believing parent in the face of outcry. As usual, citizens are light years ahead of their out-of-control bureaucracies. By the way, CASA by and large does an outstanding job, but they also have to recruit from the human population, and their Advocates will sometimes be poor, but most of the time they arent.

This bill is an affront to the constitution. This bill would take away our right to due process and our right to protection against unreasonable search and seizure. To top it all off, we are encouraging a legal process that completely flies in the face of our legal concept of 'innocent until proven guilty'.

CPS by law has to investigate all calls or reports that come to their hotline only if they meet the criteria to be investigated. I was told that reports are investigated by the nature of the case be it life threatning to not life threatning. CPS has alot of power, and some cases are in need of investigation and some don't need to be investigated at all in my opinion. I know since the "Gates case" CPS is mandated to follow specific guidelines. I have met people that have had their children removed that should not have been, and then some that needed to be removed. I will say they all were not homeschoolers. CPS has power and if a child is removed CASA is a vital part in the best interest of the case as they are a neutral party in the case and the judges listen to CASA.

You say: "sponsored SB 1064 at the urging of child-protection advocates and court officials" but don't identify who those advocates and officials are.

You quote one person (Diana Martinez) as stating "the measure had been supported by a wide array of child advocates, court officials and health providers" but don't identify who they are.

Martinez's comment that the bill is "very similar" is simply not true.

The bill gives the court authority to force parents to give CPS access to the child and/or transport the child for "interview, examination, and investigation" WITHOUT A COURT HEARING OR NOTICE TO THE PARENT.

And worse, the language in the current statute that requires CPS to prove "good cause shown" was stricken from this bill.

SB 1440 gives the court wide and arbitrary powers to make a ruling based only on an affidavit from CPS, and one proponent of SB 1440 admits, "Some courts issue these orders ex parte, while others do not. (SB 1440) ... sets in place a uniform procedure for obtaining orders ex parte."

(An ex parte decision is one decided by a judge without requiring all of the parties to the controversy to be present.)

In other words, the proponents of the bill WANT these hearings to happen without notice to the parent and thus without them being represented at the hearing, with a lower standard than "good cause shown," to boot.

If it's really a good law and one desired by the citizens of Texas, let it stand on its own feet and be heard on its merits.

I confided in a children's pastor's wife that my husband was very emotionally abusive toward me, NOT our children. I wanted them to cover my family with prayer covering. She told her husband and he called CPS on me! Instead of covering us, this man availed me before the unbelieving public authorities CPS! I was sent to 2 phychiatrists, where I was told she was tired of CPS sending people to her that didn't belong there and I didn't belong there! Case opened 10/08 ans although no abuse was found, case is STILL open!

This bill should be stopped. We reported our neighbor's out of control dogs to the police (after several years). The day after the police came to investigate, our neighbors turned us in to CPS just to be malicious. We had to be guilty then innocent with CPS and prove we were good parents. The neighbors still have out of control dogs--nothing happened to them or the dogs. CPS has to much power.
