CPS Blank Check II

SB 1440 was delivered to the governor on June 3. He has twenty days after the end of the session to take action on the bill by signing or vetoing it or allowing it to become law without his signature, which means he has until the 21st or 22nd of June to veto the bill.

We have had people from all walks of life and from across the political spectrum who have responded to this story and joined us in calling for the veto of this bill. The more we learn about the way the bill passed, the more the more ugly the story becomes. Our friends at the Parent Guidance Center were tracking this bill in its first rendition as SB 1064, registered to give testimony against the bill on May 14, and offered written testimony against the bill. The hearing was actually on Thursday, May 14, but no testimony was taken on the bill; the next day the rules were suspended on the House floor, and the 5-day posting rule was suspended so the hearing could take place on that day (Friday, May 15). Therefore, it took place at 7:09 Friday night. There was no chance for opponents to be there because of the lack of notice, but Madeline McClure of TexProtects and Jane Burstain of Center for Public Policy Priorities, supporters of the bill, were obviously given notice and were there to support the bill . The hearing lasted an hour and 13 minutes. The written testimony of the Parent Guidance Center was not entered into the record; neither was there any record of their registered opposition to the bill. Now defenders of SB 1440 are trying to claim that there was no opposition to the bill.

SB 1440 has created a firestorm of opposition from the left and right of the political spectrum because it destroys the rights of parents who are in the midst of an investigation by CPS and have refused to waive their Fourth Amendment rights against unreasonable searches and seizures. It gives the court authority to force parents to give CPS access to the child and/or transport the child for "interview, examination, and investigation" without a court hearing or notice to the parent. Worst of all, the language in the current statute that requires CPS to prove "good cause shown" was stricken. SB 1440 gives the court wide and arbitrary powers to make a ruling based only on an affidavit from CPS, and one proponent of SB 1440 admits, "Some courts issue these orders ex parte, while others do not. (SB 1440) ... sets in place a uniform procedure for obtaining orders ex parte." In other words, the proponents of the bill want these hearings to happen without notice to the parent and thus without them being represented at the hearing, with a lower standard than "good cause shown," to boot.

Many have asked what else they can do to stop this ursurpation of parental rights, and I would suggest that people call their state representatives and state senators, asking them to call Governor Perry to stop this bill. In the meantime, THSC and other groups opposing SB 1440 will host a press conference in Austin tomorrow (Wednesday) at 1 p.m. on the south steps of the Capitol. (See our Press Release.) Media outlets are beginning to become aware of the issue. This bill must be killed!

I agree with your opposition of this bill. Ten years ago I had the same thing happen to me and both of my daughters were taken away. I spent 5 yrs fighting the CPS. My youngest daughter was 13 when this all started. I was finally found not guilty when she was 18. It took the Appeals Court to overturn it. In the mean time I lost 5yrs. with my daughter all because I was home schooling them. Please do not let this happen to any other parent.

This bill should be stopped. We reported our neighbor's out of control dogs to the police (after several years). The day after the police came to investigate, our neighbors turned us in to CPS just to be malicious. We had to be guilty then innocent with CPS and prove we were good parents. The neighbors still have out of control dogs--nothing happened to them or the dogs. CPS has to much power.

CPS workers are undereducated and overworked.
They are like a pack of dogs out of control.
The last thing Texans need is for this agency to have more power.

I have heard too many horror stories about false accusations and parents losing their children for months til things are straightened out.
We are heading the way of California, where they almost encourage you to turn your neighbor or students' parents in for abuse without proof.
Guilty til proven innocent...and proving innocent isn't easy.
Come on Texas...we're better than that.

There are kids out that that could use CPS help but their too busy hurting families that have done nothing wrong. Thank you for standing up for what is right and honest.

I confided in a children's pastor's wife that my husband was very emotionally abusive toward me, NOT our children. I wanted them to cover my family with prayer covering. She told her husband and he called CPS on me! Instead of covering us, this man availed me before the unbelieving public authorities CPS! I was sent to 2 phychiatrists, where I was told she was tired of CPS sending people to her that didn't belong there and I didn't belong there! Case opened 10/08 ans although no abuse was found, case is STILL open!

And who is it that has to pay for those visits to a psyhchiatrist or to get a lawyer to protect their rights? I doubt it comes out of the budget of CPS.

As we all have heard "I never thought this could happen to my family"...Will it has...We too were
guilty until proven innocent,in the meantime children lives were destroyed....One child(iN THE PROTECTION OF CPS) was
attacted by a dog in the face,and CPS HAS WASHED
THERE HANDS NOW THAT THE CASE IS DISMISSED.Now this sweet girl is trying to live life with this
hideous scar on her face... CPS IS OUT OF CONTROL.....

You quote one person (Diana Martinez) as stating "the measure had been supported by a wide array of child advocates, court officials and health providers" but don't identify who they are.

Martinez's comment that the bill is "very similar" is simply not true.

If it's really a good law and one desired by the citizens of Texas, let it stand on its own feet and be heard on its merits.

Oh wait! It already has.

...as SB 1064—which died in the Senate. The language from that dead bill was then amended to SB 1440 after second reading to sneak it into law against the votes and wishes of the majority of the Senate.

I agree with Lambert on this bill's assault on parental rights. But the way it was done is an assault on the Legislative process of Texas.

Gov. Perry, I call on you to veto SB 1440.

CPS by law has to investigate all calls or reports that come to their hotline only if they meet the criteria to be investigated. I was told that reports are investigated by the nature of the case be it life threatning to not life threatning. CPS has alot of power, and some cases are in need of investigation and some don't need to be investigated at all in my opinion. I know since the "Gates case" CPS is mandated to follow specific guidelines. I have met people that have had their children removed that should not have been, and then some that needed to be removed. I will say they all were not homeschoolers. CPS has power and if a child is removed CASA is a vital part in the best interest of the case as they are a neutral party in the case and the judges listen to CASA.

This bill is an affront to the constitution. This bill would take away our right to due process and our right to protection against unreasonable search and seizure. To top it all off, we are encouraging a legal process that completely flies in the face of our legal concept of 'innocent until proven guilty'.

I hope our governor will not allow such a travesty into law. I hope that this state at least has not become so depraved that we are to suffer even more by this socialistic, bureaucratic agency.

CPS and CASA are wicked organizations in TX. My child was taken away with no evidence of abuse ever submitted to the judge. Kaufman county Texas is a conspiracy scam ring that is defrauding and destroying family relationships for money. He is corrupt and so is counselor Linda Duggan and Atty Eric Williams who work hand in hand with CPS Kaufman to take children away from their parents, some who will never have the chance to see their children again until they reach 18. The names listed are for sure people who are out of control and corrupt. Kathy Sayles and Sandra Harwood of CPS are violently against fathers. Chris Gilmer of CASA is also a bad bad advocate of kidnapping children legally. go look these people up on ripoffreport.com

This is true. Judge Howard Tygrett, cps worker Kathy Sayles, atty Eric Williams, and counselor Linda Duggan all of Kaufman county TX are a ring of evil. Howard Tygrett has destroyed man parent-family relationships and uses that forney counselor Linda Duggan to do so. Linda reports in his court according to who paid her off. This are the evil monsters who took away my friends child. Note each of these monsters and beware of them!!!!

let's vote howard tygrett out of office on march 2. I hear his opponent, Raymond Shacklelford, is a very good lawyer and family man. Go Raymond!
